Terms of Service for Wagyu Mountain Lodges

Welcome to Wagyu Mountain Lodges, operated by The Wagyu Experience (Pty) Ltd. These Terms of Service ("Terms") govern your use of our website, booking services, and your stay at our accommodation establishments. By accessing our website or making a booking, you agree to be bound by these Terms. These Terms are drafted in accordance with the laws of the Republic of South Africa, including the Consumer Protection Act No. 68 of 2008 (CPA) and the Electronic Communications and Transactions Act No. 25 of 2002 (ECT Act).

2. Booking and Payment Terms
All bookings are subject to availability and are only confirmed once a deposit or full payment has been received and a confirmation email has been issued by The Wagyu Experience (Pty) Ltd. The full price of the accommodation, including all applicable taxes (such as VAT) and any other fees, will be displayed prior to the finalization of your booking.

Payment must be made via the approved payment methods indicated on our website. By providing payment information, you warrant that you are authorized to use the designated payment method. We utilize secure payment systems in accordance with accepted technological standards to protect your transaction data.

3. Cancellation and Refund Policy
Guests may cancel an advance accommodation booking by providing written notice to accommodation@thewagyu.co.za.
Unless a different cancellation policy was clearly disclosed and accepted when the booking was made, the following standard cancellation charges apply:

Cancellation more than 30 days before arrival: 25% of the total booking value.

Cancellation 15 to 30 days before arrival: 50% of the total booking value.

Cancellation fewer than 15 days before arrival: 100% of the total booking value.

No-show or early departure: 100% of the unused booking value.
These charges are subject to the Consumer Protection Act 68 of 2008. When determining the final cancellation charge, The Wagyu Experience (Pty) Ltd may consider the nature of the booking, the notice provided, the likelihood of reselling the accommodation and accepted practice within the accommodation industry.
Where all or part of the cancelled accommodation is successfully resold, The Wagyu Experience (Pty) Ltd may reduce the cancellation charge to reflect the loss actually suffered, after deducting reasonable administration, payment-processing and booking costs.
No cancellation fee will be imposed where the person for whom, or for whose benefit, the booking was made is unable to honour the booking because of death or hospitalisation. Reasonable supporting documentation may be requested.
A booking made for accommodation on specified dates does not automatically qualify for the general cooling-off right applicable to certain electronic transactions. Any statutory cooling-off right that applies because a booking resulted from direct marketing remains unaffected.
Approved refunds will be returned using the original payment method, where reasonably possible, and will normally be initiated within 10 business days after approval. The time taken for the amount to reflect may depend on the relevant bank or payment provider.
Bookings made through Airbnb, Booking.com or another third-party platform are also subject to the cancellation terms displayed and accepted on that platform. Where a third-party platform collected the payment, the refund must generally be processed through that platform.

4. Guest Registration and Identification
In accordance with the Immigration Act of 2002 and local hospitality regulations, all guests are required to register upon arrival. You must provide your full names, surname, and present a valid, original identification document (South African ID card/book or a valid passport for international visitors). A copy of your identification document will be retained for our records. Failure to provide valid identification may result in the refusal of accommodation without a refund.

5. Lodge Rules and Conduct
To ensure a pleasant and safe environment for all guests, you agree to abide by the lodge rules provided in your accommodation or communicated to you upon arrival. This includes, but is not limited to, adhering to check-in and check-out times, noise restrictions, smoking policies, and the proper use of facilities.

The Wagyu Experience (Pty) Ltd reserves the right to terminate your stay immediately, without refund, if your behavior is deemed disruptive, dangerous, or in violation of these Terms or the lodge rules.

6. Limitation of Liability and Indemnity
While we take every reasonable precaution to ensure your safety and the security of your belongings, The Wagyu Experience (Pty) Ltd, its directors, employees, and agents shall not be held liable for any loss, damage, injury, or illness sustained by any guest or their property during their stay, except where such loss or damage is caused by our gross negligence or willful misconduct.

You agree to indemnify and hold harmless The Wagyu Experience (Pty) Ltd against any claims, damages, or expenses arising from your breach of these Terms or your actions during your stay.

7. Governing Law and Jurisdiction
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of South Africa. You consent to the non-exclusive jurisdiction of the South African courts for the resolution of any disputes.

8. Amendments to Terms
We reserve the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our website. Your continued use of our services following the posting of changes constitutes your acceptance of such changes.
